TERMS OF SERVICE

OVERVIEW
Welcome to My Lumivex. The terms "we", "us" and "our" refer to My Lumivex, which operates this store and website at mylumivex.store, including all related information, content, features, tools, products and services (the "Services"). My Lumivex runs on the Shopify platform.
These terms, together with the policies they refer to (the "Terms"), describe your rights and responsibilities when using the Services. By visiting or buying from our store, you agree to these Terms and our Privacy Policy, available in the footer. If you do not agree, do not use the Services.
Nothing in these Terms limits the rights granted to you by applicable consumer protection law.

SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms, you confirm that you are of legal age where you live. To buy, we will ask for details such as your email, address and payment information, and you agree that they are true, current and complete.
You are responsible for keeping your login details secure and for activity on your account. You may not transfer, sell or assign your account to anyone else.

SECTION 2 - OUR PRODUCTS
We do our best to display our products accurately. Even so, colors may look different depending on your screen and device settings.
Our LED light strips are installed by the customer along the edge of the trunk opening and connect to the vehicle's trunk light so they turn on when the trunk opens. Before buying, measure your trunk opening and choose the length that fits it. Follow the installation instructions included with the product; we are not responsible for damage caused by improper installation or by modifications to your vehicle's electrical system.
If you are not happy with the product, our 90-day satisfaction guarantee applies, as described in our Refund Policy.
We may change descriptions, discontinue products or limit quantities sold to any person or region.

SECTION 3 - ORDERS
When you place an order, you make an offer to buy. Your order is accepted when we receive payment and send you a confirmation. We may refuse or cancel an order, for example on suspicion of fraud or an obvious pricing error; in that case we will let you know and refund the full amount.
Returns and refunds are governed by our Refund Policy. You confirm that your purchases are for personal or household use and not for resale.

SECTION 4 - PRICES AND PAYMENTS
Prices, discounts and promotions may change without notice. You will be charged the price in effect when you place your order, as shown in your confirmation email. Unless otherwise stated, prices do not include taxes or import duties that your country may charge.
You confirm that you are authorized to use the payment method you provide and that the payment information is correct.

SECTION 5 - SHIPPING AND DELIVERY
Delivery times are estimates and may vary for reasons beyond our control, such as carrier or customs delays. If your order arrives damaged, is wrong or does not arrive, contact us and we will send a replacement or refund your money, under our Refund Policy and Shipping Policy.

SECTION 6 - INTELLECTUAL PROPERTY
The Services, including trademarks, text, images, graphics and design, belong to My Lumivex or its licensors and are protected by intellectual property laws. You may use them only for personal, non-commercial purposes. You may not reproduce, distribute, modify or publish any material from the Services without our written permission.
The My Lumivex name, logo and designs are trademarks of My Lumivex. The Shopify name and logo are trademarks of Shopify. Other trademarks mentioned belong to their respective owners.

SECTION 7 - THIRD-PARTY TOOLS AND LINKS
The Services may include third-party tools or links that we do not control. You use them at your own risk, under those third parties' terms. We are not responsible for the content, products or services of third-party sites.

SECTION 8 - RELATIONSHIP WITH SHOPIFY
My Lumivex is powered by Shopify, which enables us to provide the Services to you. However, any purchases you make in our store are made directly with My Lumivex. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of the sales between you and My Lumivex, including any injury, damage or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with My Lumivex.

SECTION 9 - PRIVACY
The personal information we collect is governed by our Privacy Policy. Because the store runs on Shopify, Shopify and other providers, which may be located in other countries, process some of your information to provide the Services.

SECTION 10 - REVIEWS AND FEEDBACK
If you send us reviews, comments or suggestions, you grant us a free, worldwide, perpetual license to use, reproduce and publish them, including for commercial purposes. You agree that they are truthful, do not infringe third-party rights and do not contain illegal or offensive content. We may moderate or remove comments that breach these Terms.

SECTION 11 - ERRORS AND INACCURACIES
There may be typographical errors or inaccuracies in descriptions, prices, promotions or delivery times. We reserve the right to correct them and, if an error affects an order already placed, to cancel it with a full refund.

SECTION 12 - PROHIBITED USES
You may only use the Services for lawful purposes. Among other things, you may not: use them for illegal or fraudulent purposes; infringe intellectual property rights; harass or harm others; submit false information, spam or malicious code; impersonate another person; collect other users' data; use robots, scraping or automated tools, including AI agents, to access the Services; or bypass our security measures. We may suspend your access if you breach these Terms.

SECTION 13 - AUTOMATED AGENTS
Any software acting autonomously on behalf of a person (an "Agent") may only access the Services if it identifies itself as an Agent in each request, including "Agent/[agent name]" in its user agent, does not hide that it is an Agent, answers truthfully if asked whether it is human, and does not bypass measures we use to limit its access. We may restrict any Agent's access.

SECTION 14 - TERMINATION
We may suspend or terminate your access to the Services if you breach these Terms. You will remain liable for amounts owed up to that date. Sections that by their nature should survive will remain in effect.

SECTION 15 - WARRANTIES
Our products come with the legal warranty required by applicable law and our 90-day satisfaction guarantee. Beyond those warranties, and to the extent permitted by law, general site information is provided for informational purposes and we do not guarantee that the site will work without interruptions or errors.

SECTION 16 - LIMITATION OF LIABILITY
To the maximum extent permitted by law, My Lumivex will not be liable for indirect, incidental or consequential damages, such as lost profits or data, arising from the use of the Services or products, including damage caused by improper installation. To the extent permitted by law, our total liability for any claim related to an order is limited to the amount you paid for it. This limitation does not affect rights that consumer protection law does not allow to be excluded.

SECTION 17 - INDEMNIFICATION
You agree to hold My Lumivex and Shopify harmless from third-party claims arising from your breach of these Terms, your violation of the law or third-party rights, or your misuse of the Services.

SECTION 18 - SEVERABILITY AND ENTIRE AGREEMENT
If any provision of these Terms is found invalid, it will be enforced to the extent permitted by law and will not affect the rest. Our failure to exercise a right does not waive it. These Terms and the policies posted in the store are the entire agreement between you and us.

SECTION 19 - ASSIGNMENT
You may not assign your rights or obligations under these Terms without our written consent. We may assign them, for example if the business is sold.

SECTION 20 - GOVERNING LAW
These Terms are governed by the laws of the Republic of Colombia, without prejudice to the consumer protection rights you have in your country of residence.

SECTION 21 - CHANGES TO THESE TERMS
You can review the current version of these Terms on this page. We may update them by posting changes on the site. Changes do not apply to orders already placed. We will notify you of important changes as required by law.
